Ce este Intabularea si de ce este Obligatorie

Intabularea reprezinta inscrierea dreptului de proprietate in cartea funciara, transformand un act de proprietate intr-un drept opozabil tuturor. Din 2023, intabularea este obligatorie in Romania.

De ce este importanta intabularea?

Fara intabulare, dreptul de proprietate exista doar intre partile contractante. Prin intabulare:

  • Devii proprietar oficial — dreptul tau este recunoscut de toti
  • Poti vinde imobilul — notarul nu autentifica acte fara carte funciara
  • Poti obtine credit ipotecar — banca nu accepta garantii neintabulate
  • Esti protejat juridic — nimeni nu poate contesta proprietatea ta

Cum se face intabularea?

  1. Angajeaza un inginer cadastrist autorizat ANCPI
  2. Acesta realizeaza masuratorile si documentatia cadastrala
  3. Depune dosarul la OCPI — cerere de receptie si intabulare
  4. OCPI verifica si deschide cartea funciara
  5. Primesti incheierea de carte funciara

Termenul de intabulare

Dupa depunerea dosarului la OCPI:

  • Termen normal: 5-15 zile lucratoare
  • Termen urgenta: 1-3 zile lucratoare (taxa suplimentara)

  • Intabularea — inscriere definitiva, drept deplin
  • Inscrierea provizorie — drept conditionat (ex: pana la judecarea unui proces)

What is land book registration (intabulare)?
Intabulare is the procedure by which a real right over a property (ownership, mortgage, usufruct, easement) is recorded in the land book, becoming enforceable against third parties. Without intabulare, the right exists legally but has no effect against third parties.
Is intabulare mandatory?
Yes for ownership rights acquired after 1 July 2014, under the cadastre and real estate publicity law 7/1996. Without intabulare you cannot sell, mortgage or freely dispose of the property.
Who performs intabulare?
The notary prepares the documentation and submits it to OCPI (the Cadastre Office) along with the ownership documents. OCPI verifies and issues the intabulare conclusion. The procedure is automatic after a sale contract is authenticated at the notary.
How long does intabulare take?
The standard OCPI deadline is 18 business days. With urgent processing (double fee), it can be reduced to 5 business days. The notary submits the file within 30 days of authentication.
